When the parties cannot agree on what is in the child’s best interest, either party can petition the court to enter an Order that is in the child’s best interest. Typically, however, legal custody is equally shared between the parties. Legal custody is the right to make decisions concerning the child’s health and welfare, which may include school options, health care decisions, religious upbringing and social activities (and more).
