The Consequences Of A DUI Conviction

The penalties for a DUI conviction in Pennsylvania can be severe, especially if it is not your first conviction. The size of your fine, the length of your license suspension and how much time you spend in jail is dependent upon your blood alcohol level (BAC) at the time of arrest. A first time DUI offense where the driver’s BAC is 0.09% or less will pay about $300 in fines and be put on probation for up to six months. If a driver has a BAC of 0.16% or higher on a first time DUI, they are facing $1,000 to $5,000 in fines, 72 hours to six months in jail and a 12-month suspension of their license.

With each successive DUI, there is required jail time, community service and mandatory enrollment in alcohol and drug treatment programs and the Pennsylvania Alcohol Highway Safety School. A third DUI is a misdemeanor ad may result in prison time.

Defenses Against DUI Charges

For a first time DUI charge, you may qualify for probation and a deferred verdict or the Accelerated Rehabilitative Disposition program. Completing probation without violating its terms may allow you to remove the charges from your criminal record. When probation programs are not available, there are other options. Common DUI defense strategies include:

  • Challenging the breath test results
  • Questioning whether the traffic stop was appropriate
  • Challenging how the field sobriety test was administered

By proving that law enforcement failed to maintain a Breathalyzer or did not follow proper procedures in the DUI arrest, we can get penalties reduced and possibly get the charges dropped.
